UK Immigration Rules Update: Clearly explained changes to the Statement of Changes of Immigration Rules in an easy-to-understand manner.
Quickly
- The government’s Statement of Changes to the Immigration Rules (Statement), which affected the skilled worker and other UK immigration pathways, was released on October 14.
- Candidates for skilled workers will need to have a higher level of English (B2 instead of B1) as of January 8, 2026.
- Beginning January 1, 2027, most candidates will have their graduate visa term shortened from two years to 18 months.
- Although it will be limited to 8,000 spots each year, the High Potential Individual (HPI) pathway will grow to include more universities.
- Beginning on October 14, 2025, Botswana people will need a visiting visa in order to enter the UK, with a six-week transition period.
- The cost of sponsoring for UK firms would rise due to a 32% increase in the Immigration Skills Charge (ISC).
The government’s Statement of Changes to the Immigration Rules (Statement), which affected the skilled worker and other UK immigration pathways, was released on October 14. Additional components of the recommendations outlined in the government’s White Paper, which was released on May 12, 2025, are implemented in the Statement.
- The modifications that would affect skilled workers will go into effect on January 8, 2026.
- Below is a summary of the Statement’s main modifications.
English proficiency requirements for skilled workers have increased from level B1 to level B2.
Applicants for authorisation through the skilled worker route must provide proof that they are proficient in English at a level of B2 according to the Common European Framework of Reference for Languages. While the existing level B1 requirement is more akin to a GCSE quality, this is a higher threshold that is more comparable to A-level English.
Employers must make sure that this necessity is recognised and taken into account during the hiring process. If applicants must complete additional language examinations, this could result in lengthier lead times for visas.
According to the Statement, dependents of skilled workers are not required to speak English in order to seek for entry clearance or further permission. Later this year, we expect the Immigration Rules to undergo more amendments that will incorporate this provision.
This will be applicable to those who apply on or after January 8, 2026, who are new to the route. When extending their permit, people who are currently on the Skilled Worker route as of January 8, 2026, will not be affected.
Action items for employers:
- Prior to sponsorship, make sure candidates fulfil the B2 English criteria by updating the recruitment procedures.
- To prevent delays, let recruiters and hiring managers know about the change.
- For applicants who might require more language instruction or testing, take lead times into account.
- Examine job postings and eligibility requirements to ensure they align with the new standard.
Reduction in the amount of time off allotted through the Graduate Visa route
Those who seek for a graduate visa will be granted an 18-month leave of absence. Compared to the existing two-year term, this is a reduction. PhD grads are an exception to this rule, as they will still be eligible for three years of authorisation.
All applications filed on or after January 1, 2027, will be subject to this.
Action items for employers:
- Evaluate graduate talent streams and modify permanent hiring schedules (starting in 2027).
- Notify graduate recruitment programs and HR teams of any changes.
Extension of the HPI path
Currently, graduates from 50 top universities in the globe (a list recommended by the Home Office) can enter the UK and stay for up to three years through the High Potential pathway. This list of qualified universities will be doubled by the government, but the number of spots available will be limited to 8,000 annually.
Employers are urged to review applicants’ educational backgrounds and see whether the updated list may provide this possibility when other career paths become more limited.
The updated list has not yet been released.
Action items for employers:
- When the revised list is released, compare the educational backgrounds of the contenders.
- If sponsorship of talented workers is not feasible, take into consideration the HPI option as a substitute for high-skilled hiring.
- Due to the annual cap, be ready for possible competition: As soon as qualified individuals are found, take immediate action.
Introduction of the requirement for Botswana nationals to get a visitation visa
Botswana nationals who want to travel to the UK must apply for a visitor visa in advance. Previously, citizens of Botswana were listed as non-visa holders and needed just an Electronic Travel Authorisation (ETA) to enter the UK.
A visor visa must be obtained starting at 3 p.m. on October 14, 2025. For those who already have an ETA for travel to the UK before 3pm on October 15, there will be a six-week transition period.
Action items for employers:
- Encourage citizens of Botswana who intend to travel to the UK for work to apply for a visiting visa ahead of time.
- Examine future travel schedules and help impacted staff members apply for visas.
- Inform the appropriate teams and update internal travel guidelines.
An increase in ISC
Employers in the UK are required to pay the ISC when they sponsor employees under specific visa pathways, such as the Global Business Mobility (Senior or Specialist Worker) and Skilled Worker routes. For the Certificate of Sponsorship to be valid, the whole amount owed must be paid; the sponsored worker cannot be charged.
