UK Earned Settlement Rules 2026: Settlement Will Be Won by Contribution and Good Behaviour
Settlement will be won by contribution and good behaviour.
Migrants will not get the right to live in the UK forever nearly automatically after 5 years. Instead it will be earned under the new earned settlement model outlined to Parliament today.
The revisions recognise that settled status is a major privilege which gives open and unfettered access to the labour market, NHS and welfare system, and will now ensure that the length of time someone waits will depend on their contribution and character.
New UK Settlement Waiting Periods
The highest earners will be eligible to settle in 3 years. Those earning more than £50,271 and some public service personnel such as physicians, nurses and teachers will be able to pay off after 5 years. Others will land at a fresh default of 10 years. Those who have breached immigration laws will only be permitted to stay after a minimum of 20 years.
Four Mandatory Conditions for UK Settlement
Those who want to settle, regardless of when they came in the nation, will first have to satisfy 4 non-negotiable conditions:
- a clean criminal record (up from the present standard of a 12-month suspended sentence)
- English to a high standard (comparable to A-Level English as a foreign language)
- no outstanding obligation to the taxpayer
- a history of consistent National Insurance contributions
New UK Settlement Rules for Care Workers
The reforms broadly follow those outlined in the November 2025 consultation But now the Government has come up with a new equitable agreement for care workers.
Those who completed their visa restrictions and earned at least £25,000 a year will be permitted to settle after 5 years in honour of the contribution care workers gave to Britain while the sector was reeling from the COVID-19 pandemic.
But the care worker option was also misused, with rogue and predatory companies sponsoring workers for non-existent jobs.
This administration has already banned 1,800 predatory firms from sponsoring foreign labour.
A new 5-year visa will give a second chance to contribute to those who don’t qualify for 5-year settlement, which is about a quarter of the total. Only when these have been accomplished will they be eligible to apply for settlement.
The same will be true of public service professionals in health care and education who arrived in the same era.
Otherwise, settlement rules will still apply at the point of application, as has always been the case in Britain and elsewhere.
That means an estimated 500,000 people will wait more than 5 years to settle, taking billions off the assistance bill. Nobody will be compelled to go, everyone will get a fair go to apply for fresh visas that would allow them to settle after 10 years.
Prime Minister Andy Burnham’s Statement on Immigration Reforms
Prime Minister Andy Burnham said:
People want to see an immigration system that is based on control, contribution and that rewards those who play by the rules.
These suggestions build on that premise and appreciate the contribution overseas workers make to our country.
The last government lost control of immigration post Brexit with numbers spiking to an unprecedented level. “This Home Secretary is dealing with this problem and she has my full support in doing so.
It is only right that people who are making the most meaningful contribution to our communities should get to settle earlier.” People who misuse the system or come illegally will be refused or will have to wait longer , too . Those in other roles can expect to wait longer .
Home Secretary Shabana Mahmood’s Statement
Home Secretary Shabana Mahmood said:
One of the most significant rights this country can offer is settled status. It has been granted nearly automatically up to now.
It is going to be earned from now on. The fastest will be those that give the most. Those who don’t play the rules will be turned away or they will wait a lot longer.
This strategy creates a fair migration system, fair to those who come here and perform their part and fair to British residents already here, who must not be forced to carry a heavier burden.
It also outlines settlement rights for all refugees. It fosters safe, regulated, controlled and capped routes and discourages unlawful and risky small boat crossings.
New UK Settlement Rules for Refugees and Illegal Entrants
Refugees on Home Office approved routes will be permitted to settle after 5 years. Others will be fixed at 20 years, 10 years if working or studying.
Anyone who arrives by small boat, or some other illegal way of entering, will face a further 10 year delay — meaning they might wait up to 30 years to settle.
Existing Settled Status and UK Immigration Routes
Anyone who already has settled status will never lose it. Existing routes for family members of British nationals, Hong Kong British Nationals (Overseas) and members of the military forces will be maintained.
The UK will also have the most business-friendly migration system in Europe for high-skilled workers.
