UKVI has boosted the daily capacity of its post-licence priority change of circumstances service. The updated priority service material on GOV.UK now says that they will accept at least 120 requests per working day.

The update may provide some operational respite for sponsors, while demand is projected to continue to exceed supply and early filing of requests remains crucial.

Sponsors should also expect requests to be challenged and therefore ensure that each request is backed up by accurate SMS records and underlying proof if applicable.

UKVI increases daily capacity for Sponsor Change of Circumstances Priority Service

The UKVI has doubled the daily limit for its post-licence priority change of circumstances service. Sponsors now have at least 120 priority requests each working day, up from the previous minimum requirement of 100 daily slots.

The prior allocation was regularly sold out in a matter of minutes after launching. The increase to a minimum of 120 requests may alleviate some of the pressure on a service that has been routinely overloaded, but is unlikely to eliminate that pressure entirely.

Priority service is available on a first come first served basis and requests are taken Monday to Friday between the hours of 7am to 5pm (not including public holidays) and costs £350 per request.

The change is on the Home Office’s priority service information page, rather than a formal change to sponsor guidance.

UKVI has also indicated that any future changes to the allocation will be made via the Sponsor Management System discussion board. Sponsors should keep a careful eye on this, as the Home Office has the power to change capacity depending on demand.

How the Priority Service Operates

The priority change of circumstances service still provides for a limited range of request types including extra undefined Certificates of Sponsorship, key personnel changes and adjustments to organization data.

Sponsors are still need to file the appropriate change of circumstances request through the Sponsor Management System (SMS) before requesting priority consideration by email. This is because priority processing is only available where the underlying request has been lodged on the SMS and has not been allocated to a caseworker.

The service just speeds up the consideration and does not improve the chances of approval and the five working day turnaround is an aim and not a guarantee. UKVI may take longer if it needs to do further checks or if it has concerns about compliance with the request.

So the method is basic but the underlying request is not handled as routine. UKVI might also look at the substance of the change, so it is important that sponsors be certain that submissions are accurate, internally consistent and supported by adequate evidence.

  • Effects on Sponsors

Where delays would impact recruitment timelines, onboarding or compliance reporting, priority processing can be critical for employers, especially where requests are linked to CoS allocation or the replacement of key personnel, where timing can directly affect a sponsor’s ability to fulfil its duties.

In addition, the increase in daily requests should bring some gain in operational flexibility, but this is likely to be minor as demand is likely to continue to beat supply. Requesting sponsors should not take availability for granted, and should nonetheless prepare to make requests quickly after the service opens at 7am. It is nevertheless important to coordinate internally amongst HR, compliance and finance teams, especially when payment clearance is required within short timescales.

The expanded capacity also does not change the sponsor compliance framework: priority requests that are ineligible, incomplete or inconsistent with the SMS submission are still likely to be refused and, where payment has been received, the cost will not normally be returned.
