Primary Changes Introduced in HC 259

Appendix Graduate
Appendix Graduate: enables a kid born in the UK during the period of a parent’s permit under the Graduate route to apply as a dependant and be given permission in line with the parent.
Diplomatic Visa Arrangements
Diplomatic Visa Arrangements: provides the visiting visa under the Diplomatic Visa Arrangement to qualifying holders of Indian diplomatic passports.
Part 8 Children Provisions
Part 8 Children provisions: matches requirements for children joining relatives in the UK with the approach under Appendix Child Relative.
Appendix FM Partner Leave
Appendix FM partner leave: provides for partners of persons with temporary protection status to be granted leave in line with the remaining leave of the protection sponsor.

Appendix Graduate Route Changes Explained
The explanatory memorandum indicates that the adjustment to Appendix Graduate resolves a gap affecting children born in the UK where their parent has Graduate route approval. At present, however, the Rules limit dependant eligibility on the Graduate route to those dependants who have approval under the Student route. This modification permits such children born in the UK to apply as dependants and be granted leave in line with their parent, without extending dependant eligibility from overseas, or creating a route to settlement.

The current requirement of ‘serious and compelling circumstances’ is unclear as to when a child should be allowed to join a relative in the UK and is being aligned with the clearer approach in Appendix Child Relative where a child may join a relative with protection status where they have no parent or other family member who can reasonably look after them.
Appendix FM Changes
Changes to Appendix FM concern the amount of leave given to spouses of persons with temporary protection status. Where a protection sponsor has been given leave to remain for 30 months a partner awarded leave under Appendix FM will be granted leave consistent with the duration of the sponsor’s current grant.
The Appendix FM child route is changed to give effect to the care requirement in Appendix Children. This is to guarantee that children’s living and care arrangements in the UK are safe, suitable and consistent with UK legislation and to harmonise safeguarding standards across routes.
Additional Immigration Rule Amendments
